1. About Us

These Terms of Service ("Terms") govern your access to and use of www.drinkkoma.com (the "Website") and the purchase of products offered through the Website.

Throughout these Terms, "Kōma", "we", "our" or "us" refers to SAE Origine Sàrl.

By accessing the Website or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Website or purchase products through it.

2. Eligibility

Our products are intended for customers who are legally permitted to purchase alcoholic beverages under applicable Swiss law.

By using the Website and placing an order, you confirm that:

• you have reached the minimum legal drinking age applicable to our products;
• you have the legal capacity to enter into binding contracts;
• the information you provide is accurate, complete and up to date.

We reserve the right to refuse or cancel any order where we reasonably believe that these conditions are not met.

3. Products

We make every reasonable effort to ensure that product descriptions, photographs and other information displayed on the Website are accurate.

However:

• product images are provided for illustrative purposes only;
• colours may vary depending on your device;
• packaging may occasionally differ from the images displayed;
• minor variations that do not affect the quality or nature of the product shall not constitute a defect.

All products are offered subject to availability.

We reserve the right to discontinue, modify or replace products at any time without prior notice.

4. Prices

All prices displayed on the Website are expressed in Swiss francs (CHF).

Unless otherwise stated, delivery charges are charged separately and are displayed during the checkout process before the order is confirmed.

We reserve the right to modify our prices at any time.

The price applicable to your order is the price displayed at the time your order is placed and confirmed.

In the event of an obvious pricing error caused by a technical malfunction or human error, we reserve the right to cancel the order and refund any payment received.

5. Orders

Submitting an order through the Website constitutes an offer to purchase the selected products.

A contract is concluded only once:

• payment has been successfully authorised;
• the order has been accepted by Kōma; and
• an order confirmation email has been sent to you.

Adding products to your shopping cart does not reserve those products and does not constitute an order.

We reserve the right to refuse or cancel any order, including where:

• products are unavailable;
• payment cannot be verified;
• incorrect pricing is displayed due to technical error;
• fraudulent activity is suspected;
• legal requirements are not met.

At any time before shipment, we may cancel an order and refund any payment received if fulfilling the order becomes impossible or inappropriate.

6. Payment

All orders must be paid in full before they are processed and shipped.

Payments on the Website are processed securely through Shopify Payments.

By submitting your payment information, you confirm that you are authorised to use the selected payment method.

We do not store your complete payment card details.

Should a payment be declined, cancelled or subsequently reversed, we reserve the right to suspend or cancel the corresponding order.

7. Delivery

We currently deliver products within Switzerland only.

Orders may be delivered by:

• Swiss Post;
• third-party logistics or delivery service providers engaged by us; or
• members of our own team where we carry out deliveries directly.

Estimated delivery times are provided for information purposes only and are not guaranteed.

While we make every reasonable effort to deliver orders within the estimated timeframe, delays may occasionally occur due to circumstances beyond our control.

Delivery delays shall not entitle the customer to cancel an order or claim compensation, unless otherwise required by mandatory law.

8. Delivery Address

Customers are responsible for ensuring that the delivery information provided is accurate and complete.

Kōma shall not be responsible for failed or delayed deliveries resulting from incorrect, incomplete or outdated delivery information.

Additional delivery costs resulting from incorrect information may be charged to the customer.

9. Age Verification Upon Delivery

As our products contain alcohol, we reserve the right to refuse delivery where there are reasonable grounds to believe that the recipient does not meet the applicable legal age requirements under Swiss law.

Where required, the delivery provider may request proof of age before handing over the products.

If delivery cannot be completed because the age requirement is not met, the order may be cancelled in accordance with applicable law.

10. Transfer of Risk and Ownership

Ownership of the products remains with Kōma until full payment has been received.

The risk of loss or damage passes to the customer upon delivery of the products to the delivery address provided during the ordering process.

Where a shipment is left at the delivery address in accordance with the delivery instructions or the carrier's procedures, the risk transfers to the customer at that time.

11. Inspection of Products

Customers are encouraged to inspect their order upon delivery.

If products arrive damaged or if the order is incomplete or incorrect, customers should contact us as soon as reasonably possible and, where applicable, provide photographs showing the issue.

We reserve the right to request additional information before determining the appropriate solution.

11. Returns and Refunds

Due to the nature of our products, we do not accept returns or exchanges simply because a customer has changed their mind or ordered the wrong product.

Returns may be accepted only where:

• products were delivered damaged;
• incorrect products were delivered;
• the order does not correspond to the confirmed purchase; or
• applicable mandatory law requires otherwise.

If you believe your order is affected by one of these situations, please contact us at hello@drinkoma.com as soon as possible after delivery.

Where a return is accepted, we may, at our discretion:

• replace the affected product;
• issue a refund; or
• provide another appropriate solution.

Any refund will be processed using the original payment method whenever reasonably possible.

13. Product Availability

All orders are subject to product availability.

If a product becomes unavailable after an order has been placed, we may:

• offer an alternative where appropriate;
• ship the remaining available products;
• refund the unavailable item; or
• cancel the affected part of the order.

We will inform you as soon as reasonably possible if such a situation arises.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control.

These circumstances include, without limitation:

• natural disasters;
• severe weather conditions;
• pandemics;
• strikes;
• transport disruptions;
• governmental measures;
• interruptions affecting suppliers or logistics providers;
• technical failures beyond our control.

In such circumstances, our obligations shall be suspended for the duration of the event.

15. Intellectual Property

All content available on the Website, including without limitation text, photographs, illustrations, graphics, logos, trademarks, product names, videos, designs and other materials, is owned by or licensed to Kōma and is protected by applicable intellectual property laws.

Nothing contained on the Website grants any licence or right to use any intellectual property without our prior written consent.

You may not reproduce, copy, distribute, modify, publish or otherwise use any content from the Website for commercial purposes without our prior written permission.

16. Acceptable Use of the Website

Customers remain responsible for using our products in accordance with applicable laws and for storing and consuming them appropriately.

By using the Website, you acknowledge that your personal information may be processed in accordance with our Privacy Policy.

These Terms and any contract concluded through the Website shall be governed exclusively by Swiss law, excluding its conflict of law rules.

Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts at the registered seat of SAE Origin Sàrl, unless mandatory law provides otherwise.
